Solvang restaurant loses ADA suit
A
Santa Maria jury Dec. 11, awarded $5,000 to a Woodland Hills disabled man after
he sued the Mandarin Touch Restaurant in Solvang for alleged violations of the
Americans with Disabilities Act and other violations. Mandarin Touch owner Phil
Leo said he will appeal the decision.
The
jury found that Evergreen Dynasty Corporation, the restaurant’s parent company,
discriminated against the plaintiff, Jarek Molski, who is paralyzed from the chest down and uses a
wheelchair.
The
suit said the company failed to remove architectural barriers to allow access
to the restaurant, and that upon Molski’s second
visit, the corporation had intentionally maintained an inaccessible condition
at the site.
Molski has sued hundreds of California
businesses for alleged ADA violations.
